Bragg Should Prove No One is Above the Law
How Hillary Clinton can save Alvin Bragg's prosecution of Donald Trump
Manhattan District Attorney Alvin Bragg is under fire for bringing dozens of novel felony charges against former President Trump. Everyone from the President of Ecuador to Members of the European Union Parliament has denounced the Harvard-educated lawyer’s indictment as a purely politically motivated prosecution indicative of a totalitarian regime. It occurred to me that the BEST way for Bragg to prove that his indictment of Trump isn’t a politically motivated prosecution would be for him to prosecute someone from his own party that has ALREADY admitted to committing the same crime during the same election.
Bragg’s prosecution of former President Trump hinges on Trump’s failure to cause his accountants to detail the specific purpose of the payments he made to his lawyer. Trump’s accountants simply called the payments made to his lawyer “legal services” in the Trump Organization’s ledgers. Bragg argues Trump should have included details of Stormy Daniels’ accusations in his accounting ledgers. Trump’s lawyers are sure to argue, contrary to Bragg’s claims, that the Trump Organization was not required to go into any detail about what “legal services” entailed when they made their accounting entries when paying invoices from its lawyers.
On the other hand, Hillary Clinton hired the Perkins Coie law firm to draft opposition research about Donald Trump that would eventually become known as the Steele Dossier. According to the Federal Election Committee, Clinton made 40 payments to her lawyers between 1/2016 and 12/2017 totaling $5,281,161.49. Each of these payments, without exception, was accounted for as “LEGAL SERVICES”.1 While there are no federal or state laws laying out requirements for accounting entries made between private organizations—there are federal laws that require specific detail for payments made by campaigns (Hillary paid for the research via her campaign).
In fact, 52 U.S.C. § 30104(b)(6)(B)(v) required Hillary Clinton to detail and report the “name and address of each . . . person who has received any disbursement not otherwise disclosed . . . in an aggregate amount or value in excess of $200 within the calendar year . . . from the reporting committee within the reporting period, together with the date, amount, and purpose of any such disbursement.”2
Contrary to federal law, none of the payments from Hillary Clinton to her lawyers at any point in 2016 or 2017 included any payments for “opposition research,” “investigation into Donald Trump,” “payment to Fusion GPS,” or any other comparable purpose that would accurately reveal the nature of the investigative and opposition research work she hired various groups to perform.3
Just last year, Hillary Clinton admitted that her failure to properly account for these payments violated various federal election laws including 52 U.S.C. § 30104(b)(5)(A) and (b)(6)(B)(v) and 11 C.F.R. § 104.3(b)(3)(i).4 She agreed to pay a fine and the matter was dropped. Of course, her admission allowed her to avoid jail time in federal prison it does not save her from Alvin Bragg and violations of New York’s business record laws.5
Hillary Clinton6, her campaign7, and Perkins Coi8 are all domiciled in New York and under the jurisdiction of Alvin Bragg. Hillary has already admitted to falsifying business records in her various filings to the Federal Election Committee and to the State of New York—making it very easy for Alvin Bragg to make his case against the former first lady. In fact, Clinton has already admitted her guilt to more than 40 felonies under Bragg’s interpretation of New York law. If Bragg wants to ensure his prosecution of former President Trump isn’t tainted he should immediately indict Hillary Clinton—no one should be above the law.
