The ICC’s problem is not bad management. It is illegitimacy. No grand jury. No American jury. No Article III judge. No constitutional chain of consent. No accountability to the citizens whose liberty it would take. I will say this for the ICC. It was a good enough illusion for most of the world to believe that there really was a world government like in Star Trek. That’s how good the US has been in making Europe feel relevant for 75 years. The fact that everyone confused the illusion of global sovereignty for reality proved the value of the magic.
