So my hope is that our President understands more than all of us and has a better plan. And I wish the best for him and his crew in this very important time in China. Digging into this from a Trump supporter’s perspective and someone deeply frustrated with the stalled confirmation process, the inquiry yielded some facts that surprised me.
The recess appointments “work around” skirts normal Senate advise and consent role put in place by the Founders for reasons of checks and balances. Who was the first president to use this? Washington. This power, granted by Article II, Section 2 of the U.S. Constitution, was intended to ensure the government could continue functioning when the Senate was unavailable due to long travel times and extended recesses. It was for the sake of continuity of government when convening was logistically problematic, not political expediency.
Harry Reid invented the pro forma session tactic to block Bush recess appointments. Republicans later used the tactic against Obama. It went to SCOTUS. The Supreme Court, in NLRB v. Noel Canning (2014), unanimously ruled against Obama, stating that the Senate is in session when it says it is, as long as it retains the capacity to conduct business under its own rules.
Thune is supportive of the Trump nominees but wishes to see them approved through the normal procedures. He is trying to get the entire slate approved by a simple majority vote.
It appears the case that his “pragmatist” approach has its limits when conflicting with his own respect for the institutional norms established by the Founders. One can legitimately question the downstream consequences of massive recess appointments used for executive branch political expediency when in some future time the democrats regain the White House.
While the delay in the confirmation process is a major concern, preserving the advise and consent capacity of the Senate should not be sacrificed. I seriously doubt Washington, who first exercised the Article 2 powers to make recess appointments, would abide the loss of the Senate advise and consent role.
Ironically, the pro forma session tactic prevented Obama recess appointment bypass of the Senate confirmation process and imposed constraints upon Obama from nominating even more extreme candidates.
We shall see if Thune follows through on the normal Senate confirmation side as he claims.
